I believe that in the recent Seventh Circuit judgment okaying the
"partial birth abortion' ban of Illinois and another state, Easterbrook
went with the majority (ban is okay, even though vaguely worded, and
kinks can be worked out as it becomes clearer whether the vagueness does
indeed impinge on other abortions) and Posner went with the minority
(against the ban).  this decision was the FIRST time a court has upheld
a "partial birth abortion" ban.

  so at least posner was right about that!
