The employer is supposed to report the time to the BLS surveyors. Or, more precisely, a representative sample of employers is surveyed every month, reporting number of hours worked and the hourly wage rate. Once a year, the BLS compares this monthly survey with detailed state unemployment insurance data that covers over 98% of the workforce, producing its annual "benchmark" revisions. (What it learns from these full samples is then used to adjust the monthly survey over the next year.) So, in theory, the 24-hour Kinko's should be covered. But if people are actually working 8.5 hours, but are only paid for 8, hours worked will be underreported.
