Yeap. And taking specific historical conditions into consideration. For
example, abortion rights are guaranteed on the basis of the 14th amendment.
Due process generally is a good thing, even though it is sometimes abused.
Without it, we could essentially throw away our entire judicial system, for
it would be to the police officers who's guilty and what punishment, if
any, should be meted out.
