(a) He's WAAAAY too liberal to get by the Senate, or be considered for 
nomination. (b) He's too old. After this, he will be in his late 60s before 
he might have an opportunity.

A sensible Democratic appointment would be somelike like Akeel Amar at Yale, 
liberal but very quirky, an originalist on the Constitution, a 
center-rightist on law 'n order, and young--40s. --jks
