Actually, a major part of the Supremes objected primarily to the lack of a provision for the mother's health, which they felt was an "undue burden."

Gore said that "on the issue of partial birth or so-called late-term abortion, I would sign a law banning that procedure, provided that doctors have the ability to save a woman's life or to act if her health is severely at risk." So if he actually signed such a law, it could pass by the SCOTUS's muster.
