posner on bush v. gore (was RE: Ethical foundations of the left)

Webb just returned from the Great Barrington conference on Dewey and pragmatism I mentioned that Posner attended, along with Bernstein, Hickman, etc. He reports that Posner said Roe v. Wade was a mistake, they should have let the states battle it out. Webb asked him wouldn't the absence of legal abortion mean that wealthy people would have access but the poor wouldn't, or would suffer from the risks of lower cost illegal abortions. Posner reportedly replied that yes, the wealthy always have those advantages. Webb's impression was that for Posner, pragmatism means "do what you damn well please." The only Dewey Posner seemed to be familiar with were two fairly unknown articles on law.
