Is there a nonviolent response to September 11?

I'm trying to understand how the 9/11 attack is classified as a crime instead of an act of war. ObL has declared war on the US publically, and soldiers from his army secreted their way into enemy territory, captured enemy aircraft, and used them to attack important enemy sites.

The Taliban are as much of a government in Afghanistan as to be found and ObL is regognized as a member of their gov't.

So with that spin it certainly sounds like war. On the other hand, ObL is operating a worldwide criminal syndicate while hidden away in a third world country. So maybe he is a criminal.

I'm interested in the a priori classification for what makes something war vs. a crime.
