Federal wiretapping laws would make it a crime fo an ISP to disclose that they were actually using the snooping software. To be honest I'm surprised they even answered the question at all.
If people desire anonymity, integrity, and security in their email, the way to do it is with the mathematicas of cryptography, not by relying on others (especially behemoth ISPs and the State) to respect our rights.
