Here you are singing my song. I've argued for the need for law even under communism for this reason. That has no necessary connection to any notion of natural rights, though. Legal rights are social through and through.

CB: What do you mean by "law" ? Do you recognize the existence of custom before law in human society, i.e. a system of dispute resolutions without a state apparatus backing up the decisions ? Is it your position that law arises at the beginning of human society ?
