Are you sure? You're the lawyer, but I'm unaware of anywhere in the US that allows the use of deadly force in the protection of property; most places allow that breaking into your house, whether the perp knows you're home or not, is "good enough" to warrant a threat to your person ... but that's totally different from what you're claiming.
If you shoot someone who is taking your stuff, chances are good that you're going to jail.
