No, I think we are boxed in on this punitive damages thing. This term the Supreme Court voted against every disabled plaintiff's case they agreed to review. Perhaps something can be done in the employment arena in congress to define disability in a way that the justices cannot judicially "interpret" disaiblity into thin air.
