What can I say? I'm a legal theorist myself, and I think that Posner's about as good as they get. The Public Intellectuals book is an embarassment, but try, for example: Law and Literature, The Problems of Jurispridence, Frobtiers of Legal Theory, Overcoming Law . . . . Moreover, he's an excellent judge. Scalia is more slight as a theorist, which isn't saying that much, almost everyone is, but his opinions are always smart and interesting. As for inconsistencies, well, I'vbe committed a few myself. And as for the left, I wasn't making any invidious comparisons. Chuck was saying that all right wingers in govt were mediocre idiots. I listed a few I thought were pretty smart.
