It's not an official declaration of war. The last time the US declared war was in WWII. Since then this constitutional restraiont on executive powers has proved dispensible. jks

Congress did give him an open-ended authorization. I don't know if that counts, but it doesn't matter in practice. Plus there was the President's speech that Ian fwd'd.

I didn't think too much of the comment, since demands to release POWs could also be countered by turning them into "enemy combatants."
