That's not the exact analog; how about you put _the company_ in jail? Breaking news: Enron passes itself around for cigarettes; Enron: not allowed to vote; Enron: no revenue from selling a book about the swindle.

The CEO is just a hired flunky, sorta like your pool boy: if someone drowns in your pool, the pool boy doesn't get sued: you do. If you run someone over in your SUV at a party, your mechanic doesn't go to jail, you do.
