Annoying, to be certain, but otherwise quite harmless.

They cannot take any legal action based on that surveillance, at least not yet. So if the empire thinks that it is up to something while spinning its wheels in such a foolish and useless manner - what is wrong with that?

And the constitutionality-of-it thing? You do not have any illusions that this piece of paper matters to this country's ruling elite, do you? After all, Bush himself said it does not. So what else did you expect?
