One of the things that I don't understand is that many Palestinian men in the West Bank (especially those of working age who most likely had odd jobs in Israel) can understand an speak Hebrew pretty fluently. Zakariye Zbeide, Tali's contact in the Al-Aqsa Martyrs' Brigade, definitely could speak fluent Hebrew...

So...why would they need Tali to translate the military documents that the court accuses her of translating?

It definitely does seem to be trumped up charges...at least on this specific charge...

Pro-Palestinian activist Tali Fahima will be released from administrative detention and placed under house arrest, the Tel Aviv District Court ruled on Monday.

Judge Zvi Gurfinkel delayed the implementation of the court decision for 24 hours, in order to allow the state to appeal the ruling. Fahima will be confined to her mother's home in Kiryat Gat. She will be required to post bail of NIS 15,000.

"It appears that reading from a document that falls into the hands of activists in a terror organization, and is translated by the accused, does not present a level of risk requiring her to be detained behind bars until the end of proceedings," Judge Gurfinkel ruled.

The judge referred to charges that Fahima, an Israeli Jew who had gone to live with members of the Al-Aqsa Martyrs' Brigades in Jenin, interpreted an Israel Defense Forces aerial photograph the organization had obtained. The photograph showed the homes of wanted individuals in the city. Prosecutors argue Fahima thus helped members of the militant group escape arrest.

The judge added that still, "this is not to belittle" the acts attributed to Fahima. Gurfinkel said that the serious thing was that the document had come into the enemy's possession.

Fahima was arrested nearly six months ago. Her defense attorney, Samadar Ben-Natan argues that the state has reversed itself. When Fahima was arrested, Ben-Natan states, investigative bodies said there was not enough evidence for a standard indictment. Fahima was thus placed under administrative detention. However, the attorney argues that the state had the material in the current indictment before it decided to make use of administrative detention.

Last week, Fahima asked the court to cancel a substantial part of the indictment against her. According to Ben-Natan, Fahima's case fits criteria the High Court of Justice has set for wiping out an indictment when it is shown that branches of the state were hostile to the accused, and prevented him or her from receiving a fair defense.
