Sorry, it's absolutely legal. The rule in America is "employment at will," meaning the boss can fire you for any reason or none, so long as there is no law or agreement to the contrary. (They can also fire you for working at home.) Smokers are not a class protected against discrimination by any law (so far as I know), therefore it's tough luck for them. jks
