Harry Cole, author of the essay posted on the WFMU blog, is a former Howard Stern writer (now an FCC attorney for the station).
His deconstruction of the FCC's inconsistent, twisted pretzel logic rulings is very familiar to those of us who listened to Stern during his final year on terrestrial radio.
Some of the most compelling content of that final year's show was Stern's detailed descriptions of precisely the sort of topsy turvy actions Mr. Cole discusses. At the time, Howard was agitating for an industry counter-offensive to the FCC's arbitrary and infantilizing putsch. Needless to say, this was wishful thinking: capital only becomes involved in legal tangles to defend or enhance profit-taking.

Having read Cole's essay (and recalling Stern's mini-lectures on the topic) I'm now curious to learn who the personalities are behind this latest effort to make the airwaves safe for...well, who exactly?
