You seem to be somehow overlooking the fact that you have Guantanamo. So what you mean to say is "what we have is a very bad system, but it is not Guantanamo. Except Guantanamo". If you say it like that it sounds pretty silly.
Its like a citizen of Nazi Germany protesting that "what we have is a very bad system, but it is not Auchwitz."
