Legal Loopholes Will Not Absolve UHW-W Officers from Returning Members' Dues Money:
Tuesday, the Ninth Circuit Court dismissed SEIU v. Rosselli on a technicality. The judge's ruling says nothing about the merits of the charges of wrongdoing—in fact, it allows a separate and similar lawsuit filed by a rank-and-file UHW-W member to go forward.
Both suits seek restitution for the balance of the more than $3 million in dues money that the defendant UHW-W officers unlawfully transferred to a separate account to fund their own agenda. To date, the UHW-W officers have still not returned more than $100,000 of members' dues money.
As the member suit goes forward, SEIU will determine if it is in the best interest of our members to appeal Tuesday's decision. In the interim, the internal charges filed against UHW-W's Sal Rosselli by two UHW-W members for the same reason will also go forward.
