I think Nussbaum's beef has to do with Butler's very real appeal, because she sees her leading people away from a politics based on filing lawsuits. Anyone living in the U.S. in 2008 who still thinks we're going to move things left by way of the courts is, as Chomsky might say, not living in the real world.
