I totally agree that this is a big mechanism for stifling democracy. It's worse than the electoral college. But for FWIW, this isn't in the constitution. It's only based on custom (perhaps reinforced by the exigencies of game theory). But legally speaking, there is nothing in the constitution that would prevent any or all states from dividing their votes proportionately.
