If you don't have the law, pound the facts. If you don't have the facts, pound the law. If you have neither, pound the table.

The Senate Rules are "just" rules: they are subject to interpretation and susceptible to precedent.

Even this particular rule has been modified over the years by precedent.

*shrug* I don't see any change coming anytime soon.
