Huh? There's still no certified union at the workplace. To run another election the union has to expend resources again, which could be considerable given turnover in the restaurant industry. Many union supporters are likely discouraged after having not won the election. And the boss, who generally speaking has more resources than the union, is free to run another union-busting campaign if the union decides to try again. Hard to see how this could be a victory.

We get plenty of close losing election results overturned by the board, only never to run the units again.
