That is obvious. The judges finding was explicitly based on the Obama attorney's repeated refusal to state that Ellsburgh, Hedges, et. al. had no reason to fear that their free speech activities would lead them to be persecuted under this law.

So do I, because it is a very rare judge who rules according to the law in "national security" matters.
