But the size and make-up of the judiciary are determined by the legislature and the president, which can expand the SCOTUS as much as necessary and appoint justices committed to approve progressive legislation as constitutional. The problem thus is not constitutional, not the judiciary. It is the lack of a people's party able to mobilize a majority to replace the capitalist political establishment (of course a democratic majority vote to establish a people's government would face a military-police coup. A socialist revolution could only develop in the course of mass democratic struggle against that coup).
