Shane Mage:

In desperate need of *some* extenuation for his Bushit friend Obama,

^^^^^ CB: Obama needs no defense in this.

^^^^

cb comes up with the fantasy that willful violation of the Fourth Amendment (the supreme law of the land) is not a "crime."

^^^^^ CB: It's not. For example, failure to give Miranda warnings ( you have the right to remain silent, etc.) is a violation of the 4th ( or 5th) Amendment, but it is not a crime. Have you ever heard of a police officer prosecuted for not giving Miranda warnings ? No. It is the basis for excluding a confession obtained as evidence at trial, but not a crime.

Crimes are passed by the Congress and state legislatures. Violations of the Constitution are not crimes, in general. I forget whether the wording on treason directly establishes a crime.

In this case, there is a specific illegal wiretapping criminal statute. However, there is another statute that gives an exception for big spooks.

Nonetheless, Obama didn't wiretap anybody. So, he is not implicated.

^^^^^

His boy took an oath to uphold the constitution. His deliberate and willful violation of that oath is exemplary of the "high crimes" for which the penalty is impeachment and removal from office--not "exclusion" of the "evidence" which his boy every week uses to decide whom to murder!

^^^^^^^ CB: Shane has become an out-of-his-fucking-mind ultra-left Obama-hater. I think Obama is becoming Stalin for, you old boy. Obama has really betrayed the revolution. Why don't you send that idea to the Nazis...I mean the tea Republicans in the House of Reps. ?
