appeal making it if the Supreme Court takes the case.

I doubt it. The S.Ct will not take the case, and my guess is that the DC Cir. hears about six re-rehearing en banc (full court) a year. The lawyers will have to move for a rehearing and petition to the S.Ct., but that's the ball game for practical purposes. Scum--I mean the News & Freep & the DC Cir. --jks
