Yes, it's the same guy, Sam Cummings of some district in Texas. (No relation to Walter Cummings of the 7th Cir. FCt, of Appeals in Chicago, for whom I clerked--a wonderful man and a great judge, now alas ina better place than this.) This is the worst sort of judicial activism. If a liberal judge did this, she would be denounced by the right in the strongest possible terms.

No, I don't think there are other collective rights in the BoR, except maybe in the 10th amendment, which reserves rights to "the states, or to the people." But the collective charcter of the rights in the @A is textual: there's that stuff about a "well-regulated milita."
