where is the democracy?

or maybe a little of both ? what if making a case for popular action is illegal ? for ex: in japan it is illegal for public servant at _any_ level of the state (it includes some contract workers in public agencies) to strike and to have any kind of political activity. obviously this impairs a lot any kind of democratic movement here.
