Well, it seems some group called Coalition of Clergy have taken George Walker Bush, et. al. to court on the `unlawful combatants' in GITMO.

The petitioners seek a writ of habeas corpus, to identify the persons involuntarily detained, that each of them be physically produced before the court for a determination of statuses, and for any further action. Petitioners cite US Cons. Art 1, sec 9, para 2 and 28 USC 2242-43, to the effect that district courts and any circuit judge may grant such writs.

The US District Court Central District of California, ordered arguments filed by 01/31/2002 which are to be quote, pithy and brief, unquote, to show cause, why a writ should not be issued. Decision is set for 02/8/2002.

To see both the petition and the order to show cause, see:

If you don't want to bother reading these, I'll tell you the court didn't sound too happy with our Reichsfuhrer Aschroft's lackies. The order is dripping with sarcasm directed at what must have been highly arrogant and dismissive attitudes and arguments put forth by the US attorneys.

Not that I expect much, but it is supposed to be a US court with a real live judge who might just be pissed that the entire judicial branch of government has been circumvented by the executive branch.
