If the fees are racially discriminatory, it's a
violation of federal law -- Fair Credit Act (probably)
and associated regs, among other things -- and if the
state has legally validated or ratified this action,
that's what the 14th Amendment is for: No State shall
deny and person . . . the equal protection of the
laws.
