If the Delphi and GM screwees make strategic decisions of this great importance on the recommendations of lawyers they have already lost everything. But if they are willing to risk the breaking of the UAW, horrible fines and losing their (by now half-pay for full work) jobs to replacements (which as you know can "legally" be done in a completely "legal" strike), they stand a chance to win.

It is emphatically not a lawyer's job to advise clients on whether or not to act illegally. No sensible person would go to a lawyer with such a question.
