I don't believe they were asked to comment on that question, right? They were just asked: can the President really do this? And the answer was "you bet your bippy" ...

^^^^^^ CB: They should have said "no way jose". This is so blatantly unconstitutional that they should have raised it sui sponte ( that means on their own) even if the lawyers didn't raise it. However, if the lawyers didn't raise the constitutional challenge, they should be sued for malpractice.
