in the u.s., first amendment indicates that congress (now government, i guess, via incorporation), will not make laws abridging freedom of speech, private businesses and associations (and individuals) are not limited by first amendment...

many (most?) folks are probably not aware that first amendment speech protection is not applicable in the workplace (public sector workers have some measure of protection), courts have routinely sided with employers in such matters, 'at' will' employment thank you very much...

marcuse's critique of disempowering consequences of 'pure tolerance' has merit given 'one-dimensional' control of media even if his proposal for turning holmes' notion of 'clear and present danger' upside down via 'intolerance' towards status quo - racism, militarism, imperialism - ignores historical use of 'c&pd' argument as rationale for repressing political left... mh
