There is some degree of choice -- short of complete,to be sure -- as to
where you can work as restaurant staff. You might be a smoker and want to
work in a smoker-friendly place. Or you might prefer that your workplace be
for smokers in the hope of trading for a little better job benefits. The
importance of second-hand smoke outside of infants and pregnant women is not
a foregone conclusion, AFAIK. Leaving all these choices to the state makes
it a good candidate for nannyism. There's no bright line, but I think it's
possible to go too far.

Smoking in restaurants, bars etc is a question of workers' safety, not
of the rights of either customers _or_ smokers. When was the question of
safety on the job a matter of nannyism?
