Russia Today was reporting yesterday that a statutory immunity under
Japanese law would prevent any suit against GE under Japanese law. This
alleged loophole wasn't explained, but was cited as a blanket immunity.
TEPCO and other Japanese plaintiffs could try their luck in a US court, but
if the contract between GE and the appropriate Japanese entities called for
the application of Japanese law, that might foreclose GE from facing any
legal liability. Apparently Obama was lobbying the Indian government on
GE's behalf to relax potential liability under Indian law for GE's
development of Indian nuclear power, but the Indian government was having
none of it. One would guess that is off the table now.
