Do you just make stuff up or repeat what you heard on a street corner?
No one saw *the entire fight* but Jonathan Good testified in the trial that he saw M on top of Z, punching him ("pretty much throwing down blows") shortly before the shot was fired. Jeannee Manalo testified that she saw a man on top of another man, swinging his arms ("The one on top was moving" she said, while making a punch-like gesture). The question has arisen whether it wasn't Z on top of M (it was dark, fog-of-war and all that), which could have made a big difference: if Z was on top, he would have been "winning" the fight, and thus the shooting would be murder. But the defense also produced evidence that the shot fired was in contact with M's shirt, but not his skin, which strongly suggests that it was M on top with his shirt hanging down; if reversed, the powder burns on the shirt and skin would have been different than they were.
