Could be. The Sentencing Guidelines are very harsh. I dealt with a case where the defendant stole $130 million and got--I am not making this up--740 years in jail, plus three years of supervised release, plus 75 hours of community service in lieu of a fine. Of course Michael Andreas of ADM only got three years for criminal price fixing. This isn't special leniency for the super rich. Its more or less read off a grid. --jks
