The only counterargument I can think of is that the victim apparently considers any further engagement with the matter traumatic. But it's an outrage against common security, not a tort. This is the whole reason we have the state engaging in retribution in the first place. Lock him up; the only miscarriage of justice here is that he got to have an acclaimed and prosperous career for all these decades.
