[lbo-talk] US Supreme Court upholds 'Obamacare'

Ken: The Repugs win. The individual mandate of course was long supported by Romney and was supported as far back as 1989 by the Heritage Foundation.

[WS:] That's water under the bridge, no? Right now, the racist wingnut branch of the Repug party made the issue into its war cry against Obama and they lost, and that is priceless in itself. It is like seeing the kkk getting their asses kicked - nice to watch, even if it does not change the nature of capitalism or even the US power structure.

I noticed the Medicaid provision and it is sad in a way, but again not surprising. There is along standing argument in certain segments of the US left that such means tested programs are doomed anyway, and the only way to go is to support universal ones. From that pov, the "universal" (if that word is warranted in this context) aspect of Obamacare survived.

What bothers me more is that this care demonstrate the enormous power the SCOTUS has in this country - seemingly greater than that of the Congress. This is really scary - not only because it is nine unelected fellows not accountable to anyone but also because what is the basis of their decision - perceived logical consistency with a vague 18th century text. As they say, if you hire enough lawyers you can prove beyond reasonable doubt that the sun orbits the flat earth supported by four elephants standing on a gigantic turtle. It is nice when those lawyers happen to be on your side, but the whole system does not inspire much confidence.
